Our Approach to Trial Litigation
HEGGE & CONFUSIONE, LLC brings the same level of dedication to trial litigation as it does to appeals, providing the highest quality representation to our trial-level clients.
Our approach to trial litigation? It's marked by three simple promises to our clients:
1. We take cases on to win them at trial, not to settle
A common complaint that we've heard from people over the years is that many lawyers promise to fight for them when they're retained but then do just the opposite. They never pursue the evidence that's needed to prove the case, they don't communicate with the client along the way, and they then effectively force the client to settle the ill-prepared case as it nears trial — resulting in a settlement that often times is good for the lawyer but not the client.
Our philosophy? We take client cases on to win them — not to settle. In part because we've litigated so many hard-fought appeals over the years, we understand that clients achieve results and feel satisfied with their legal experience not through ill-prepared compromises but through well-prepared and hard-hitting litigation that gains an advantage over the adversary and threatens the adversary with losing the case before the judge or jury.
We fight for our trial clients by aggressively pursuing the testimony and evidence that's needed to prove the legal elements of their case. Beginning with our initial meeting with the client, we gather the evidence the client needs, moving the case swiftly toward resolution at trial.
If settlement talks occur along the way, we evaluate offers or demands with an eye on the evidence that we have obtained on our client's behalf and against the backdrop of the legal claims to be contested at trial. Our appellate experience, once again, helps us identify and evaluate the legal issues that matter most, helping us assess and discuss with you the true likelihood of success at trial and whether a settlement offer or demand is worth accepting. When cases settle, therefore, they settle because it's a good result for our client.
2. We maintain a hands-on commitment to clients throughout the case
When you retain Hegge & Confusione, you retain Hegge & Confusione. Ms. Hegge and Mr. Confusione remain personally involved in your case not just in initial discussions with you but throughout your case — pretrial, trial, appeal, and beyond.
You'll work with the partners of our Firm in assessing and pursuing the testimony and evidence that's needed to prove your case. We don't delegate these important responsibilities to an unfamiliar staff of junior lawyers or paralegals with whom clients often are unfamiliar.
3. We work efficiently and smartly to maximize the value of your legal costs
From the moment we're retained, we establish with our clients the fees and costs they can expect to incur in their case. You establish the ground rules. We help clients understand and manage their expenses while meeting their litigation goals. This gives our clients the benefit of true cost certainty in litigating their disputes.
We tailor our services to fit a client's need in each particular matter. From general representation to assistance with discrete issues or situations, our clients determine how we can best help.
We offer various fee arrangements. In many cases we offer our services for a flat, one-time fee, providing total cost certainty for the client. We also offer "per service" fees (depending on the type of services you want us to perform in a particular case). We offer traditional hourly-based billing and contingency fees (in some cases) as well. We provide estimates to clients on request.
For the convenience of our clients, we accept various payment methods as well, including payment via credit card. |
